Design and construction procedures for factory facilities in industrial zones for foreign enterprises

Below is a detailed process consisting of 5 main steps, from applying for an investment license to completing the procedures for commencing manufacturing operations in an industrial park.

Step 1: Apply for an Investment Registration Certificate

This is the first and mandatory step for foreign-invested enterprises (FDI) wishing to invest in Vietnam.

Required documents:

- Investment project proposal, including information on the project scale, objectives, investment capital, and implementation schedule.

Competent authority: The Management Board of the Industrial Park (IZ Management Board) or the Department of Planning and Investment (DPI) of the relevant locality.

Processing time: 10–15 working days from the date a complete and valid application is submitted.

Result: The enterprise receives an Investment Registration Certificate (IRC), a legal document confirming its right to make investments in Vietnam.

After obtaining the IRC, the investor must proceed with registering the establishment of a legal entity in Vietnam in order to operate lawfully.

Required documents include:

Step 3: Apply for a Construction Permit for the Factory

Once the investment and enterprise establishment procedures have been completed, the investor may proceed with the design and construction of the factory.

The construction permit application includes:

- Technical design drawings prepared by a qualified consulting firm.

- Land use rights certificate or land lease agreement within the industrial park.

- Investment Registration Certificate and Enterprise Registration Certificate.

- Fire prevention and fighting appraisal approval document and Environmental Impact Assessment (EIA) report.

Competent authority: The Industrial Park Management Board, in coordination with the local Department of Construction.

Processing time: Approximately 15–20 working days.

Note: Factory buildings must comply with QCVN 06:2022/BXD (Fire Safety), QCVN 07:2016/BXD (Technical Infrastructure), and TCVN 2737:1995 (Loads and Actions).

Step 4: Complete Post-Construction Legal Procedures

After construction is completed, the enterprise must carry out inspection and registration procedures before commencing operations:

- Apply for an Environmental Permit or confirmation of completion of the EIA.

- Conduct safety inspections for electrical systems, boilers, elevators, pressure vessels, and other relevant equipment.

- Obtain a Certificate of Eligibility for Fire Prevention and Fighting (issued by the Fire Prevention and Fighting Police Department).

- Register the tax identification number, open a bank account, make the company seal, and notify the seal specimen in accordance with regulations.

- Register for social insurance, recruit employees, and sign employment contracts in accordance with regulations.

Step 5: Apply for a Certificate of Eligibility for Manufacturing Operations
